Tapage injurieux ou nocturne

I have a friend who lives in a flat and she has a child who is 2 years old. Her neighbour complained about the noise of her child even during at day and weekends. Her neighbour even said that she should move to the campagne with no neighbours and that she is a bad person with no respect.

She is new in France and doesn't know what to do in this situation. Does a toddler at that age could be consider as tapage injurieux ou nocturne? Can she complain to the gendarmerie about her neighbour for harassment?

The kid doesn't know what he/she is doing. her neighbor must have a little considertion about the situation because kids are kids you can't stop them.
